TERMS

By commissioning the artist, the client agrees to the terms of service below;
it is the client's obligation to ensure they understand the TOS

GENERAL TERMS

- Client must affirms and guarantees that the character design(s), reference material(s) and other intellectual property provided to the Artist are legally obtained and authorised for use by the Client.- Artist reserves the right to refuse commission projects for any reason.- Artist may use commercially licensed, copyright-free and/or educational materials, assets, and/or tools.- Artist will not copy or heavily reference unauthorised materials.- Unless client wishes to keep the comission private, artist may choose to publish the commission on social platforms or other sites for portfolio purpose, prior of which client will be notified.

COPYRIGHTS & USAGE

ARTIST RIGHTS- The Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios and more.- Clients are allowed to commission artworks that contain 3rd-party material (i.e. characters, logos, images, etc). HOWEVER, Artist will not be held liable for any infringement cases; unless explicitly stated by the Client, ALL commissioned works will be FOR PERSONAL USE ONLY, and Artist will be working under this assumption.- If the Client uses commissioned artworks that contain 3rd-party copyrighted material for whichever commercial purposes, Artist will not be held responsible for any infringements.CLIENT RIGHTS- Unless the commission is for commercial usage, clients receive exclusive, non-transferable usage rights to the work for personal use.- Personal use includes: display on social media accounts with no direct monetization, such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.- Client must not take credit of the work as their own and must credit Artist- Client must not edit or alter any element of the work in any way without Artist's consent.- Any usage of Artist's Work for AI tools, platforms or programs; machine learning; NFTs; or blockchains is strictly prohibited.- Any usage of the commissioned work for unlawful or harmful purposes is strictly prohibited.COMMERCIAL RIGHTS- Commercial usage rights are NOT included unless the commission type is explicitly stated by the Client.- Commercial rights means usage of work in any monetized instances, as a part of any product, or on another platform.

IF THE CLIENT VIOLATES ANY OF THE COPYRIGHT TERMS MENTIONED ABOVE, THEIR RIGHTS OVER THE WORK WILL BE RETRACTED AND THEY WILL BE BLACKLISTED FROM FUTURE COMMISSIONS.

PRICE & CONTACT

PAYMENT & FEES

PAYMENT- Payment is only possible through Paypal so far.- A 50% down payment is possible if the commission costs more than $200.- Payment must be made before the commission is started.- Once Artist has started working or payments have been made, the Client acknowledges the work and deliverables are digital and there are no physically shipped goods to receive.- After the sketch preview is sent, until the rest of the payments are completed, further process of the work will NOT be given to the Client with payment plans. CLIENT'S RIGHTS OVER THE WORK WILL BE RETRACTED IF FULL PAYMENT IS NOT MADE.PRICE & FEES- There will be a small PayPal transaction fee added to the total.- Prices listed under are base prices and may increase depending on the complexity.- An urgent deadline will result in additional charges.- Additional character(s) will result in either an x1.5 or x2 of the price, depending on the complexity.- Negotiation is not possible.- Proportions of the picture can be flexible for knee-up/full body option.- Additional fees will be charged for any major/minor revisions. (See Process & Revisions below.)COMMERCIAL SERVICE- Commercial usage will result in additional charges, typically 2-3x of the original cost.- If you plan to use your commission for commercial purposes, please contact me first so we can discuss it.

CANCELLATION & REFUNDS

- Refunds are available as long as Artist have not started working.- Artist reserves the right to cancel any ongoing commissions for whichever reason they find appropriate/necessary; Client will be provided a full refund if it occurs.- The client has the right to request refunds if the finished work has not been delivered after the deadline.- If Artist cannot complete work or there are delays for unforeseen reasons, the Client may be eligible for a full refund. If work done up to this point is accepted and used by the Client, the Artist will provide a partial refund according to the amount of work completed.

WILL DO:- Original character(s)- FanartsWILL BE REJECTED:- Explicit NSFW / Pornographic, fetish, offensive, or inappropriate content- Copied art styles- Loli / Shota- Mecha- Furries- Extreme gore- Excessively exaggerated anatomy- Coupling / Shipping depiction that is not OC x OC- Identities or cultures that Artist may not be able to portray authentically

PROCESS & REVISIONS

PROCESS- To ensure the Client and Artist's ideas align, the Client is encouraged to provide reference materials, specific instructions, set expectations and requirements, and other materials the Artist may use prior to the start of the commission.- Time of completion will vary depending on the Artist's queue order, circumstances and the complexity of the commission. If any delay occurs, the Client will be informed accordingly.- Deadlines can be discussed ahead of time (in specific cases this may increase the price). Otherwise, there is no absolute date of completion.- Artist will provide client updates on the project for ETAs between the steps, revisions and approvals.- Please pay attention and try to revise/ask for modification meanwhile, otherwise no edit is possible once the picture is done.
- Example: Artist will NOT go back to changing poses once the project has moved on to the lineart/colouring process. If the Client still wishes to proceed, they will be charged according to the amount of work Artist must redo.- Upon completion of the commission, the Client will receive 2 exports of the finished work in .jpg and .png formats. Can be sent through email or Google Drive folder.REVISIONS- The artist may decide if the revision is major or minor, which is correlated to the amount of time and effort it will take.- Unless Artist has completely misunderstood the clearly given directions, any major change of the pose WILL be charged.- 3 or more minor revisions for each of the steps (sketch, lineart, color) will result in additional charges.- Simple revisions such as coloring adjustment (simple changes of hue, saturation, value, etc) and adding/editing small details can be done free of charge.- Excessive revision will result in additional charges.

COMMUNICATION

- Client can choose their preferred means of communication, which can be through Email or Twitter (X) private message.- Artist's response time may vary, up to a week in order to provide better or more concrete updates.- Communication about the project and its progress is welcomed and encouraged. However, any discussions about unrelated topics may NOT be acknowledged, especially personal or sensitive topics.
